Everything governing how we work together, what you can expect from us, and what we need from you.
Section 1
By accessing or using any service provided by Tarqeyah ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
These Terms form a legally binding agreement between you and Tarqeyah. Using our services means you have read, understood, and accepted them, along with our Privacy Policy and any other policies referenced here.
Legal capacity
By accepting these Terms, you confirm you have the legal capacity to enter this agreement. If you are signing on behalf of a company or organisation, you confirm you have authority to bind that entity.
Section 2
Tarqeyah provides digital solutions. The scope, deliverables, and timeline for each project are set in the service agreement signed before work begins.
Web Development
Custom websites, e-commerce, CMS, web applications, and maintenance.
Mobile Apps
iOS, Android, cross-platform, App Store optimisation, ongoing maintenance.
System Development
ERP, CRM, custom business systems, database design, and API development.
Digital Marketing
Social media management, SEO, content marketing, paid advertising, email campaigns.
Visual Production
Photography, video production, graphic design, brand identity, motion graphics.
AMC Services
Security updates, performance optimisation, backups, technical support, monitoring.
All services are provided under mutually agreed contracts. Scope, timeline, and deliverables are clearly defined before any work begins.
Section 3
All payments are made in the currency stated in the contract. We accept bank transfer, credit card, and other methods agreed in writing. Prices exclude applicable taxes unless otherwise stated.
For app development, web development, system development, and branding services, payments follow a three-phase structure:

Source code
Source code for development projects is not included in the quoted price. Ownership of source code requires a separate written agreement and additional payment. For example: a 5,000 BHD application quote covers the working application, not the underlying code.
Digital Marketing (excluding Social Media Management), Visual Production, Photography, Videography, and one-off projects require 100% payment in advance unless a different schedule is agreed in writing.

Overdue amounts accrue a 2% monthly fee. Services may be suspended after 15 days overdue and terminated after 30 days overdue.
Any work outside the agreed scope requires a written change request with cost and timeline estimates approved before work starts. All IP rights remain with Tarqeyah until full payment has cleared, and no deliverables are transferred until then.
Section 4
No-refund policy
All payments made to Tarqeyah are non-refundable. This applies to all services, at all stages of a project.
Custom work from day one
Every project is tailored to a specific client. Dedicated time, team members, and resources are allocated immediately after contract signing.
Intellectual effort starts immediately
Strategy, research, and design work begins as soon as the agreement is signed, regardless of when deliverables are due.
Third-party costs
Many projects involve non-refundable licences, tools, and services purchased specifically for your project.
Committed team capacity
Once a project starts, team capacity is committed and cannot be reallocated without real costs on our side.

Any changes to the original scope must be documented in writing and may affect cost and timeline. Verbal agreements are not binding.
Client obligations
Clients agree to provide timely feedback, supply required content and assets, and adhere to agreed payment schedules.
Section 6
Our Annual Maintenance Contract keeps your digital assets secure, up to date, and performing well. AMC is mandatory for the first year after project delivery and strongly recommended beyond that.
Security updates
Regular security patches and vulnerability fixes to keep your system protected.
Performance optimisation
Monthly audits and improvements to keep load times and uptime in good shape.
Technical support
Priority support with guaranteed response times for issues and queries.
Backups
Automated backups and disaster recovery procedures run on a regular schedule.
Content updates
A limited number of minor content updates each month are included.
24/7 monitoring
Continuous uptime monitoring with automated alerts if something goes down.
Section 7
All IP rights in deliverables stay with Tarqeyah until full payment is received. On full payment, ownership of the agreed deliverables transfers to the client, except for:
Source code ownership
Quoted project prices cover the deployed solution only. Source code ownership is separate and requires its own written agreement and additional payment.
On full payment, the client receives a non-exclusive, perpetual licence to use the deliverables for their intended purpose. This licence does not include the right to resell, redistribute, or sublicence the deliverables without written consent from Tarqeyah.
All content Tarqeyah produces (written posts, photography, video, website copy, and marketing materials) goes through client approval before publication. Once approved, the client takes full responsibility for its accuracy, legality, and any consequences of its use.
Confidentiality
Both parties agree to keep confidential any proprietary information shared during the project. This obligation survives the end of the agreement.
Portfolio rights
Tarqeyah may showcase completed work in its portfolio and marketing materials unless the client specifically requests otherwise in writing.
Section 8
General limitation
To the maximum extent permitted by law, Tarqeyah is not liable for any indirect, incidental, special, consequential, or punitive damages.
Maximum liability
Tarqeyah's total liability for any claim will not exceed the amount the client paid for the specific service giving rise to that claim.
Force majeure
Events beyond our control, including natural disasters, civil unrest, or infrastructure failures.
Client delays
Delays or failures caused by the client not providing required materials, feedback, or approvals on time.
Third-party services
Disruptions to third-party services, hosting platforms, or external APIs outside our control.
Unauthorised access
Security breaches resulting from the client's failure to follow security recommendations or best practices.
Data loss
Loss of data that the client was responsible for backing up or that occurred outside our infrastructure.
Approved content
Any consequences arising from content the client reviewed and approved before publication.
The client agrees to indemnify Tarqeyah and its team against any claims, damages, losses, or expenses arising from:

Termination by Tarqeyah
Tarqeyah may terminate with 30 days written notice for any reason, including:

All outstanding payments become due immediately. Work remains Tarqeyah's property until paid. We give no refunds on amounts already paid. Confidentiality obligations continue after the agreement ends.

Section 10
These Terms are governed by the laws of the Kingdom of Bahrain. Bahrain courts have exclusive jurisdiction over any disputes.
Disputes should first be addressed through good-faith negotiation between both parties before any legal proceedings are initiated.
Both parties agree to comply with all applicable laws and regulations of the Kingdom of Bahrain.
Tarqeyah may update these Terms at any time. Changes take effect on the date they are posted to this page.
If any provision is found unenforceable, the remaining provisions continue in full force and effect.
These Terms, together with the signed service contract, form the entire agreement and replace all prior communications.
Failure to enforce a provision at any point does not constitute a waiver of that or any other provision.
These Terms are provided in English. In the event of a discrepancy between versions, the English version governs.
